Joshua Graham Packer, 22, is facing a sexual assault charge in relation to the 2009 Faria Beach murders of Brock and Davina Husted; Davina was pregnant. Packer was indicted in July 2010 for the three murders, plus three special circumstances because the murders were committed in the course of burglary and robberies, and the crimes included multiple murders.
On May 4, the Ventura County grand jury indicted Packer for forcing Davina to engage in oral sex and for using a knife to commit the crime, which comes with a special circumstance allegation stating that the murder occurred during this act. Packer is eligible for the death penalty or life in prison without parole due to this special circumstance allegation of forced oral copulation.
On his prior indictment, he pleaded not guilty to the murder of the Husteds. Davina was stabbed 30 times, Brock was stabbed 20 times. Packer allegedly entered wearing a motorcycle helmet, armed with a knife as he burglarized the home, robbed the couple and committed the murders.
Packer appeared in court on May 7 on the latest indictment and asked to postpone the hearing until May 16, when he is expected to enter his plea. A motion to consolidate both indictments will also take place on the same day.
